Restrictions
The SASDVF Board of Directors utilizes the MPAA Rating system and will determine an overall rating for the festival, not individual entries. Entries that would be eligible to receive an “X” under the MPAA system are not allowed.
Festival winners will be selected from all entries and will be judged by a qualified, multi-person panel to ensure unbiased and fair judging. Prize amounts will be based on money collected as well as financial participation from colleges, universities, and community colleges within the contest region.
Entries can be submitted by individual students and by student groups; the contest is open to anyone enrolled in any educational institution, regardless of age, sex, nationality, or religion. Entries must be original works that have not been previously published, displayed, or exhibited. No more than one entry per person or group is allowed. Submitters must be the creators of the submitted work, holding the full copyright ownership therein. All required data must be filled in. Incomplete or inaccurate form data will not be accepted. No purchase necessary for entry. No submissions will be returned and no notification of receipt will be made. Entrants shall bear any and all expenses incidental to submitting work, including, but not limited to, production and shipping costs, custom clearance, and insurance premiums (if any). The organizer cannot assume any responsibility for any loss or damage to the entries.
Legal Liability
Without prejudice to the generality of the foregoing, under no circumstances shall organizer, sponsors, and other supporting companies, and their employees, contractors (including judges and special judges), licensees, officers, and directors (collectively, the “related parties”) be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the operation of this festival, including loss or damage to entries. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if the related party has been advised of the possibility of such damage. In case the applicable jurisdiction does not allow said absolute exclusion of liabilities, the related party’s liability in such jurisdiction shall be limited to the repayment of actual out-of-pocket expenses incurred by the entrant in order to make the entry, or to the minimum extent permitted by law.
Fair Use
Copyright to the entries belongs to its respective creator. However, each entrant expressly agrees that the organizer and its licensees may publish, reproduce, display, exhibit, perform, show, print, distribute, or edit, in any media, such entries, as well as each prize-winning entrant’s name, image, and likeness (except for children under 16 unless prior parental consent has been obtained) for the purpose of promotion and public relations for the festival (including any future sequels), and its result, at no charge, anywhere in the world, in perpetuity.
Copyright
For art films, or music contained in the entry, the entrant assumes all responsibility to obtain all necessary rights and permissions, including without limitation from the original creator or model, before submitting the entries. Each entrant expresses and represents that: the entrant has the right to submission and to grant the rights herein set forth; there is neither law nor binding agreement which prohibits entering into this contest; the entry does not contain anything illegal under applicable laws; the entrant owns exclusive ownership in and to the entry; and said use of the entry and name, image, and likeness of the entrant by the organizer and its licensees will not infringe or violate the rights of any third party or constitute a libel or slander or an invasion of the right of privacy of any third party. Upon the organizer’s request, an entrant shall provide a sufficient proof of said ownership to the organizer. The organizer will not be responsible for any claims or complaints from any third parties that arise from any breach of above representations. Each entrant further agrees to defend, indemnify, and hold harmless the related parties from all liabilities, claims, and expenses, including attorney fees that may arise from or in connection with their use of entry and name, image, or likeness of an entrant. Without prejudice to the foregoing, the organizer reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the entrant, in which event the owner will cooperate with the organizer in asserting any available defense.
Technical Failures
The organizer is not responsible for technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled, or delayed computer transmissions, whether caused by the organizer, user, or by any equipment or programming associated with or utilized in the contest or by any technical or human error.
Disqualification
If the entrant fails to comply with any term of the rules, the organizer reserves the right to immediately disqualify the entry, as well as the right to cancel the award and to demand the return of award and or money, without prejudice to recovery of any further damages.
Loopholes
The organizer reserves the right to determine items not covered in the rules. If the entrant does not agree with such decision, the entrant may withdraw from the contest, although in any event, an entrant is not entitled to reimbursement of any expenses associated with entry into the contest.
Unless otherwise specified herein, the rules constitute the entire agreement between the entrant and the organizer with respect to the contest and supersede all prior contemporaneous communications and proposals (whether oral, written, or electronic) between them with respect to the contest. If any part of the rules is held invalid or unenforceable, the portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties and the remaining portions shall remain in full force and effect.
Personal Information
Organizer uses an entrant’s personal information to (i) notify the entrant about the contest and (ii) to contact the entrant about the work. Organizer will also use an entrant’s personal information when organizer notifies the entrant about similar contests that organizer holds in the future. The Organizer does not make its mailing list available to third parties.
